Where the legal basis is not expressly stated in this privacy policy, the following applies: The legal basis for obtaining consent is Art. 6 para. 1 and Art. 7 GDPR; the legal basis for processing for the performance of our services and the implementation of contractual measures, for responding to inquiries, for fulfilling our legal obligations, and for safeguarding our legitimate interests is Art. 6 para. 1 GDPR. Cooperation with Processors and Third Parties

Where we commission third parties to process data on the basis of a so-called “data processing agreement”, this is done on the basis of Art. 28 GDPR.

Transfers to Third Countries

As a rule, we do not transfer data to third parties located outside the European Union.

You have the right to request confirmation as to whether data concerning you is being processed and to obtain information about such data, as well as further information and a copy of the data in accordance with Art. 15 GDPR.

In accordance with Art. 16 GDPR, you have the right to request the completion of data concerning you or the rectification of inaccurate data concerning you.

In accordance with Art. 17 GDPR, you have the right to request the immediate erasure of data concerning you or, alternatively, in accordance with Art. 18 GDPR, to request the restriction of processing.

You have the right to receive the data concerning you that you have provided to us in accordance with Art. 20 GDPR and to request the transfer of such data to other controllers.

You also have the right, pursuant to Art. 77 GDPR, to lodge a complaint with a competent supervisory authority.

Right of Withdrawal

You have the right to withdraw your consent at any time with effect for the future in accordance with Art. 7 para. 3 GDPR.

Right to Object

You may object to the future processing of data concerning you at any time in accordance with Art. 21 GDPR. The objection may, in particular, relate to processing for direct marketing purposes.

Deletion of Data

The data processed by us shall be deleted or restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated otherwise in this privacy policy, the data stored by us shall be deleted as soon as it is no longer required for its intended purpose and provided that no statutory retention obligations prevent deletion. If data is not deleted because it is required for other legally permissible purposes, its processing shall be restricted, meaning that the data will be blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.

In accordance with statutory requirements in Germany, retention periods apply in particular for 6 years pursuant to § 257 para. 1 HGB (commercial books, inventories, opening balance sheets, annual financial statements, commercial correspondence, accounting documents, etc.) and for 10 years pursuant to § 147 para. 1 AO (books, records, management reports, accounting documents, commercial and business correspondence, documents relevant for taxation, etc.).

Hosting

The hosting services used by us serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, security services, and technical maintenance services, which we use for the purpose of operating this website.

In this context, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, interested parties and visitors of this online offering on the basis of our legitimate interests in the efficient and secure provision of this online offering pursuant to Art. 6 para. 1 GDPR in conjunction with Art. 28 GDPR (conclusion of a data processing agreement).

Collection of Access Data and Log Files

We, or our hosting provider, collect data about each access to the server on which this service is located (so-called server log files) on the basis of our legitimate interests within the meaning of Art. 6 para. 1 lit. f GDPR. Access data includes the name of the accessed website, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user’s operating system, referrer URL (the previously visited page), IP address, and the requesting provider.

Log file information is stored for security reasons (e.g. to investigate misuse or fraudulent activities) for a maximum of 7 days and then deleted. Data whose further retention is required for evidentiary purposes is exempt from deletion until the respective incident has been finally clarified.

Contact

When contacting us (e.g. via contact form, email or telephone), the user’s details are processed for the purpose of handling and processing the contact request in accordance with Art. 6 para. 1 GDPR. User information may be stored in a customer relationship management system (“CRM system”) or a comparable inquiry management system.

We delete inquiries if they are no longer required. Statutory archiving obligations remain unaffected.

Sources of Funding

The website is financed exclusively by the dentist and content owner and is operated without advertising.

The use of contact data published as part of the legal notice obligation by third parties for the transmission of unsolicited advertising and informational material is hereby expressly prohibited. The operators of the website expressly reserve the right to take legal action in the event of the unsolicited transmission of advertising information, such as spam emails.
